Terms and Conditions of Sale

  1. The Customer by making an order for Goods by any medium does so on the basis that the Customer has read, understood and agrees to be bound by the trading terms of Blue Fitness Ltd (“BF”) and having relied solely upon its own judgment in this respect.  
  2.  Should the Customer have any queries regarding these terms it should seek independent legal advice before making an order.  BF is not responsible for any incorrect interpretation of these terms by the Customer.  The following provisions shall also apply to any quotations issued by BF and to any orders made by the Customer pursuant to any such quotations:
  3. A non-refundable cash deposit equivalent to 25% of the total price is to be paid by the Customer to BF upon acceptance of this quotation.  The balance is due upon delivery of Goods. Note: Until the deposit has been received the order will not be processed by BF.
  4. Each treadmill requires a 15 amp circuit breaker and a dedicated 15 amp outlet (NEMA 6-15R).
  5. The standard lead time for the delivery of Goods by BF is 8-12 weeks from receipt of the deposit and confirmation of order; however this may vary between orders.
  6. Colour details of Frame and Upholstery will be confirmed prior to order.  BF is not responsible for minor variances in colour due to manufacturing process
  7. Estimated delivery costs will be clearly advised in writing by BF at the time the Customer accepts the quotation.  BF will endeavor to have Goods delivered and installed on the agreed delivery dates but will not be held liable for any direct or consequential loss or damages arising from late delivery or installation for any reason.  Late delivery or installation does not entitle the Customer to cancel any order or withhold payment. 
  8. Any extra costs incurred in delivery and installation due to unplanned storage or access issues or split installation requests that are beyond the scope of the quotation and are outside the reasonable control of BF shall be the responsibility of the Customer and any extra costs so incurred by BF shall be billed to the Customer.
  9. Any quotation expires 7 days from the date of the quotation whichever is the earlier.
  10. Any variation to the above terms is to be agreed to in writing by both BF and the Customer.
